Terms of Service

General Terms of Service

The purpose of this agreement is to help both the artist and client come to a good-faith, clear understanding about the terms and objectives when asking for an art commission.1. The client provides clear and complete requirements and expectations upfront, including reference materials or assets before working on the commission.2. The client grants to the artist non-exclusive rights to observe and replicate the client's own character design, reference material and other intellectual property for the use of the artwork.3. The client warrants that the character design, reference material and other intellectual property provided to the artist are legally obtained and authorized for use by the client.4.The client warrants that they have the authority to enter this agreement, be the point of contact and is solely responsible for decisions and approval during the process.5. The artist strives to perform to the best of their ability in good faith and warrants that the artwork is 100% original according to Artist’s best knowledge.6. The artist may use commercially licensed, copyright-free and/or educational materials, assets and/or tools.7. The artist warrants that they will not copy or heavily reference unauthorised materials.8. The artist defines scope of work, features, price, deliverables and other details for the project in a proposal in a format according to Artist discretion which may include private message through Discord, Twitter, Tumblr, or email. The details set forth by the artist shall be agreed upon by the client before work begins.9. The artist reserves the right to cancel or refuse a commission based on content, subject, or other reasons: poor communication, inappropriate behavior, or violation of the TOS. Clients will be notified in advance on the cancellation, and subsequent refund.10. The artist will not be depicting any of the following in their commissions: hateful, bigoted, or violent imagery/symbols, or explicit pornographic content. Some elements will be on a special, case-to-case basis such as erotica, pin-up, violence, and gore.

On Adoptables Design

By obtaining my 'Adoptable Design' in Discord, Toyhouse, or any other platform, you are agreeing to the following rules as well as the terms in the artist's General TOS. Failure to comply with these terms will result in a blacklist, a ban from obtaining future designs, and to revoke ownership of the design:Rights to Adoptable Design Use
1A. The 'Adoptable Design' is for the client's personal use only, unless specified otherwise (see 'On Commercial Rights'). The client reserves the right to rehome their design.
2A. The client may request for edits or modifications on the design after purchase, however, the artist retains the right to make any said adjustments (fees will depend on how minor or major the edits are)
3A. The client may not use the design for hateful or immoral purposes
4A. The client may not edit the image of the Adoptable Design or claim it as their own
5A. The client may not use it for commercial purpose (see On Commercial Rights)Rights to Adoptable Design Rehoming
1B. All Adoptable Designs the artist makes will need 1 week cooldown before it can be traded, gifted or resold.
2B. All Adoptable Designs can not be resold for a higher price than what it is obtained for, without any additional paid assets. Personal art, gifted art, and art obtained via trade do not count as added value to the Adoptable Design.
3B. Gifted or Free Raffled Adoptable Designs cannot be traded/resold without any added assets.
4B. Adoptable Designs obtained through trade with no monetary addition will have 0$ value.
5B. In Toyhouse: the original and unedited version of the Adoptable Design must be kept for proof of ownership and documentation, in case of future ownership changes or reversions.

1C. Payment Plans: the client must clearly and concisely indicate it in a comment or directly message the artist for a payment plan; this option is available for purchases above 200 USD, unless the artist states otherwise. Downpayment of 30%-50% is required (depending on sales amount) within the first 24 hours of the invoice.
The expected timeframe of payment plans is 1-2 months minimum, with longer plans or payment amounts are to be discussed.2C. The client will not receive any files until the balance is fully paid.
3C. In Toyhouse: The artist's auctions or sales on Adoptable Design must maintain transparency and accountability; when the client is amending offer/s, do not delete any comments or message. Instead, edit or send another comment or message.
4C. Failure of the client to comply with any of the rights to Adoptable Design Sales will result in a strike or a blacklist.Other Adoptable Design Caveats and Disclaimers
1D. If there are circumstances that lead to you being unable to pay for a design, please let the artist know as soon as possible
2D. The client is not allowed to rehome any of the artist's Adoptable Designs to blacklisted users.
3D. Reasons for Blacklisting: Breaking TOS, Users that are blocked by the artist, Scammers, design thieves, and copying (taking heavy inspiration) from other designs4D. Co-ownership of the artist's designs are allowed. However, the artist is not included in the clients' ownership disputes. Once payment has been made, the Adoptable Design is considered sold. Reselling, trading or gifting after purchase will be between the relevant clients.

On Commercial Rights

1. Commercial usage rights are not included unless specified in the commission type or listing on the Artist’s websites (i.e. V-tuber models, stream overlays, emotes, and so forth) or as agreed upon.2. Commercial rights means usage of the artist's artwork on streams, videos and other content, or any monetized instances, or selling or reselling Work to another party, as a part of any product, or on another platform.3. In the case of design work for the definition of the client's brand identity such as character design, logo design, and more, intellectual property rights of the designs and their likeness are exclusively granted to the Client for use, production and modification purposes, commercial or personal.4. Additional charges will be required for commercial usage if not included, typically 2x of the original cost.5. Usage of Work for AI (artificial intelligence) tools, platforms or programs; ML (machine learning) tools, platforms or programs; AI or ML training; NFT; blockchain; or other for-profit platforms/purposes, is strictly prohibited.

Payment and Refund

1. Commission slots will be prioritized by payment-first basis.3. All personal information between the artist and buyer will be kept private and confidential.4. All prices are for the base level of work involved with each commission type. Prices may be subjected to change depending on the complexity, difficulty, and size of the piece.2. Client payment can be 100% up front or 50% up front, 50% after sketch approval.3. Do not send the payment yet until both artist and client have agreed on the commission details and invoice.4. The final artwork will not be delivered until payment is complete.5. The client is not allowed a refund once the artist started working on the commission. If for any reason, the artist is unable to start your commission, you will receive a full refund.6. Prices are in USD, and paid via Paypal, or methods as provided by the artist.7. The client warrants they will not issue chargebacks. The refund policy mentioned below will be followed.

Timeline and Work Process

1. The artist provides progress updates and seeks for client feedback voluntarily.2. The timeline depends on commission type, complexity, and workload.3. The completion of the commission requires 3 weeks minimum, and may take 1 month, depending on complexity of each commission.4. If there are any delays and adjustments to the timeline, the artist will inform the client.5. Revisions will only be permitted during the sketch and color planning stages. Any revisions after this will only be minor. Last minute revisions or changes on the final work will incur additional charges.6. If the client is working on finalizing a character's appearance and would like the artist’s input, the artist may suggest ideas and features to include, to be discussed and agreed with the client.7. Final deliverables are provided by the artist using Google Drive, or similar file transfer tools.8. The client will have the right to request for refund after deadlines if the work has not been delivered, and there was no agreed or amendment to the timeline.

Copyright and Usage

1. The artist retains copyright, ownership, redistribution and intellectual property rights, which includes but is not limited to display, advertising, printing, the Work and work in progress on websites, social media, portfolios, public broadcast channels (i.e. Twitch) and more.2. The client retains all rights to their respective characters, unless the work done is considered 'Fan-Art'.3. The commissioned work will include a subtle signature/watermark of the artist that the client may not remove or erase.4. The client may use the commissioned piece for personal use. Personal use would be defined as: display on social media accounts for promotional purposes with no direct monetization, such as profile pictures, banners, and posts; print and framing in personal spaces; display as part of designs on websites and channels, excluding use in content of these websites or channels5. The client may use the image in edits (such as mood boards, wallpaper, icons, or other kinds of graphics), to be used in a non-commercial, digital format, without prior permission from the artist.The following is considered copyright infringement:On matters of non-commercial art: The reproduction or usage the copyrighted artwork commercially - The client is not allowed to make a profit from the artwork. This includes the sale of the digital files, or rights to the image.Claiming the artwork as the client’s own.Removing the artist’s signature from the artwork.Last updated: 07/05/2026
